For the avoidance of doubt, Equipment Data will be collected from you if you hire any Equipment from us, even if you do not request any traffic analysis services;

(a)              to improve and optimise our service offering and customer experience, including by analysing traffic or driver behaviour, creating a data set or report of such behaviour and monitoring the effectiveness of safety programs;

(d)              if there is an accident or incident relating to the Equipment during the hire period, e.g. to verify the location of the Equipment at the time of the alleged accident or incident;

(e)              to identify the exact location of the Equipment in the event of a reported breakdown and to provide that location to breakdown responders;

(f)               to identify whether the Equipment is being used in an area prohibited under any agreement with you or in a manner that does not comply with manufacturer’s specifications or any agreement with you;

(g)              to comply with our obligations under any agreement with you; and

(h)              any other purpose permitted under the Privacy Act or any other law.

By hiring any Equipment from us, you agree to our use of a GPS Device on the Equipment during the hire period, and to our collection, use and retention of any Equipment Data. You also agree and acknowledge that:

(a)              We own all right, title and interest (including intellectual property rights) in the Equipment Data;

(b)              We are not required to share the Equipment Data to you unless you have entered into an agreement for us to share that Equipment Data with you; and
